Strata Records
STRATA RECORDS!
I just put this together, and it took a while to transcribe
it into plain language that a post secondary graduate can digest. So I'm
sharing it in case it helps others.
I suspect the time it took me may be a big part of the CRT's
reluctance to order production of strata records that are not specific enough
to suit them. They keep saying they want claimants to keep sorting it all out,
instead of the strata, property management company, or CRT doing it just
once.
Section 35 Strata corporation records provides that the
strata corporation must
a) permanently retain the strata plan, any disclosure statement required by the Real Estate Development Marketing Act, plans from the developer for building permits, or any document that indicates the location of a pipe, wire, cable, chute, duct, any information respecting the construction, installation, operation, maintenance, repair and servicing of any common property or common assets, any resolutions that deal with changes to common property, court decisions, legal opinions, and depreciation reports,
b) retain manuals, schematic drawings, operating instructions, service guides, manufacturers' documentation and other similar information respecting the construction, installation, operation, maintenance, repair and servicing of any common property or common assets until until the disposal, replacement, or expiry of the warranty,
c) retain for at least 6 years books of account showing money received and spent with the reason, and minutes of meetings with the results of votes,
d) retain contracts, including indemnification agreements or insurance policies for 6 years after they end,
e) retain for 2 years correspondence sent or received by the strata corporation and council,
f) prepare current records that include phone numbers or short notice contact information for council members as required by the SPR s.4.1, a list of owners, the strata bylaws and rules; bank statements, and Information Certificates
g) any depreciation, risk management, or engineering reports, or reports respecting repair or maintenance of major items or any items for which information is required in a depreciation report.
